I'm very confused about this issue.

Microsoft and Nokia are partners now. (Samsung tags along too, iirc)

Nokia's cell phones will use MS's operating system. What exactly does that mean?

MS does not sell it's software. It's licensed. A license means a right to use. You do not own the product, or actually; the product they're selling is only a right-to-use.

Nokia is by far the biggest company on the cell phone market (something like Nokia 36%, Motorola 15%, Ericsson 5%).

If all nokia cell phones start running MS software... what exactly happens? Will MS stick to their policy of only licensing the software? Will they continue to impose on us EULA's with ridiculous terms like (and I quote from the MS Frontpage Express eula)

"You may not use the software in connection with any site that disparages Microsoft, MSN, MSNBC, Expedia, or their products or services, infringe any intellectual property or other rights of these parties, violate any state federal or international law, or promote racism, hatred, or pornography ."

If this clause would (after slightly amending it) be used on the cell phone eula's it would pretty much mean that you are in breach of contract if you call someone with your Nokia and talk about sex, racism or how MS sucks.

Just like that MS could force hundreds of millions of people to give up their freedom of speech at the moment they opened the package containing Nokias new cell phone (which, according to the agreement automatically constitutes assent).

I'm officially freaked out now. :(

well, if that is really the case, i don't think nokia would agree with it.

Site? Is that what it said? I suppose that means website. Nokia can not use the technology on any website that does the above. That has nothing to do with freedom of speech when you are talking on your phone!

That was from MS's Frontpage Express. The quoted EULA has nothing to do with cell phones BUT if they'll use the same type of EULA's in Nokia products... O.o :(

I still say that EULAs are CYA, and that 50%+ won't apply to me, and furthermore, nobody's gonna fry my arse over it.

Microsux is a monopoly... Fortunately, Unix is storming forward! :)

Besides I think that you are a little conspiratorical, when it comes to EULAs.
